In All Families Healthcare v. Montana, two Montana abortion clinics–All Families Healthcare and Blue Mountain Clinic, represented by the ACLU of Montana, the Center for Reproductive Rights, and Dechert LLP–asked a Montana state court to block a series of new restrictions on abortion clinics that were issued by the Montana Department of Public Health and Human Services in September, 2024. DPHHS created the rules after the 2023 Montana Legislature passed House Bill 937, which singled out abortion clinics for onerous and unnecessary licensing requirements.
A court order issued in 2023 prevented HB 937 from being enforced immediately. That order expires on November 19, 2024, when the new rules will impose onerous and unnecessary requirements that will make it more difficult for clinics to stay open and harder for patients to access abortion care.
