The ACLU sued Custer County after sending letters to encourage them to remove a large Ten Commandments sculpture and a seasonal Nativity scene from the courthouse lawn, citing separation of church and state. In July 2000, Custer County Commissioners voted to remove the Ten Commandments pillar instead of moving it and erecting pillars engraved with relevant portions of the Magna Carta, English Bill of Rights, U.S. Bill of Rights and the Montana Constitution. Since the settlement was entered, the County donated the Nativity to a local nursing home.
