Espinoza v. Montana Department of Revenue

Montana’s constitution explicitly prohibits aid to religious schools. However, the 2015 Montana legislature passed a bill that allowed tax credits for families who send their children to religious schools. The case made its way to the Montana Supreme Court. We filed as Amici to the Montana Department of Revenue. On December 12, 2018, the Montana Supreme Court reversed a District Court ruling in favor of the plaintiffs, stating plainly that the tax credit program violates the Montana constitution.
