That's why when we found out that juvenile, female and solitary confinement prisoners at the Missoula County Detention Facility were trapped inside with no opportunity for outdoor exercise -- even though adult male prisoners were given an hour each day outside -- we went to work.
One of the things we are most grateful for in 2013 is that we were able to settle our lawsuit with Missoula County, ensuring that all prisoners -- men, women and children -- will have an opportunity each day to spend one hour outside.
The fresh air, sunlight and exercise offered through outside recreation are constitutional requirements for jails and prisons, which must care for prisoners' physical and mental health. Furthermore, providing the opportunity for outdoor exercise to men, but not women or children, violates equal protection rights.
We're glad that we were able to make sure that no child will be left inside the Missoula County Detention Facility.
