The 2023 Montana Legislative session (the most recent session) saw an onslaught of attacks on the 2S-LGBTQIA+ community. From banning gender-affirming care to targeting drag performances, during the 2023 session many legislators tried to effectively penalize the experience of being 2S-LGBTQIA+. The ACLU of Montana is committed to protecting the rights of queer and trans people in all aspects of life and is prepared to challenge any legislation singling out queer Montanans for  discriminatory treatment.

We're tracking the following 2025 legislation that could impact 2S-LGBTQIA+ rights:

 HB 121, an anti-trans bathroom bill, stigmatizing and discriminating against transgender, intersex and gender nonconforming Montanans, while raising serious questions about privacy, safety and enforceability. ACLU of Montana OPPOSES this bill.

 HB 400, an anti-trans education bill, allowing educators and other public employees to misgender or use the wrong name when referring to transgender students. ACLU of Montana OPPOSES this bill.

HB 446, an anti-trans bathroom bill, revising indecent exposure laws to persecute trans people in restrooms and changing rooms. ACLU of Montana OPPOSES this bill.

 SB 164, an anti-trans healthcare ban, criminalizing healthcare for transgender youth, despite the fact that every major medical association in America endorses the provision of this type of care. ACLU of Montana OPPOSES this bill.

 SB 218, an anti-trans healthcare bill, creating excessive liability requirements around gender-affirming care, even though most medical care has no such requirements. ACLU of Montana OPPOSES this bill.
