The ACLU of Montana, in partnership with ACLU and Legal Voice, filed a complaint [see PDF documents, below] against the State of Montana over HB 121, a newly enacted law which stigmatizes and discriminates against transgender, intersex, and gender-nonconforming Montanans by effectively barring access public facilities and private nonprofit domestic violence programs. Along with the Complaint, the plaintiffs filed an emergency application for a temporary restraining order that would put the new law on hold. The plaintiffs include transgender and intersex Montanans along with domestic violence shelters and advocacy organizations.   

The lawsuit filed in Missoula County District Court today asserts that HB 121 violates numerous constitutional provisions, including the right to privacy and equal protection. Click here to read the ACLU of Montana’s press release announcing the lawsuit.
