UPDATE: On March 11, 2025, a Montana district court permanently blocked several restrictions that would have effectively eliminated abortion access for most Medicaid patients, especially those who live in rural and tribal communities. The court agreed with abortion providers that the laws violate Montanans’ constitutional right to abortion.

In All Families Healthcare v. Montana, two Montana abortion clinics–All Families Healthcare and Blue Mountain Clinic, represented by the ACLU of Montana, the Center for Reproductive Rights, and Dechert LLP–asked a Montana state court to block a series of new restrictions on abortion clinics that were issued by the Montana Department of Public Health and Human Services in September, 2024. DPHHS created the rules after the 2023 Montana Legislature passed House Bill 937, which singled out abortion clinics for onerous and unnecessary licensing requirements.
A court order issued in 2023 prevented HB 937 from being enforced immediately. In October, 2024, the Center for Reproductive Rights, the ACLU of Montana, and Dechert LLP asked the Court to block the rules on an emergency basis before they took effect. On November 15, 2024, the Court granted that request, meaning that the restrictions will remain blocked as the case proceeds.
