House Bill 791 will do nothing to disrupt the supply and demand for opioids and will not prevent a single overdose—it will target low-level dealers who often sell to support their drug use, limit judicial discretion to order treatment instead of prison, and exacerbate the harms of the drug war. People who are incarcerated can’t access treatment and face disproportionately higher risk to overdose. The list of harms is endless.
