We filed an amicus brief with ACLU and ACLU of Arizona in this case laying out reasons why the Plaintiff's request for a preliminary injunction should be denied.

Plaintiffs challenge a 100-day pause of certain types of removals that prioritizes other removals and enforcement actions while the Biden administration develops longer-term immigration policies. In doing so, they seek to upend the federal government’s discretionto temporarily stay certain removals and determine immigration enforcement priorities. Plaintiffs’ case relies on legal errors, misunderstandings of the policy at issue, and baseless speculation. It should be rejected.

We believe the 100-day deportation pause is legal, encorceable, and an important step in reforming immigration policies that worsened under the Trump administration.
